Terms and Conditions – Ballie Live

These terms and conditions apply to the use of the Ballie Live website (https://ballielive.com) and the Ballie Live mobile applications.
By accessing or using our website or app, you agree to be bound by these terms.
1. Use of the website and app
The information on our website and in our app is provided for general informational and entertainment purposes only.
While we strive to keep the information accurate and up to date, Ballie Live makes no guarantees regarding the completeness, reliability, or accuracy of the content.
2. Accounts and registration
To use certain features of the Ballie Live app, you may need to create an account. When you create an account, you agree to:
• provide accurate and complete information
• keep your login details and password confidential
• take responsibility for all activity that takes place under your account
Ballie Live may suspend, restrict, or terminate accounts that violate these terms, are used for fraudulent or abusive purposes, or harm other users or the service.
3. User-generated content and conduct
The Ballie Live app may allow you to create a profile, take part in pools, and interact with other users. You are responsible for the content you share.
Ballie Live has a zero-tolerance policy towards abusive behaviour and objectionable content. You may not post, share, or transmit content that is unlawful, offensive, harassing, hateful, threatening, or otherwise objectionable.
We reserve the right to remove content and to suspend or terminate the accounts of users who violate this policy, without prior notice.
You can report objectionable content or abusive behaviour by emailing info@ballielive.nl, or through the in-app report function where available. We aim to review reports and remove violating content, or remove the responsible user, within 24 hours. You can also block other users so that their content and contact are hidden from you.
4. Ballie Pools
By taking part in a Ballie Pool, sending an invitation link, or accepting an invitation from another user, you agree that certain profile information may be visible to other participants within that specific Pool. This information may include your display name, username, profile photo, selected team preferences, predictions, scores, rankings, and other information necessary for the Pool to function. Ballie Live only shares this information within the relevant Pool environment and to facilitate the services offered.
5. Purchases and payments
The Ballie Live app may allow you to purchase merchandise and other products. By placing an order, you agree to pay the price shown for the product, including any applicable taxes and shipping costs, which are displayed before you complete your purchase.
Payments are processed by secure, third-party payment providers. We do our best to ensure that prices and product information are accurate; in the event of an obvious error, we reserve the right to cancel the order and refund any amount paid.
6. Shipping and delivery
Estimated delivery times and shipping costs are shown during checkout before you complete your purchase. Delivery times are indicative and may vary. Risk of loss or damage passes to you upon delivery. If your order does not arrive within a reasonable time, please contact us so we can help resolve the issue.
7. Right of withdrawal, returns and refunds
If you are a consumer in the European Union, you have the right to withdraw from your purchase of physical goods within 14 days of receiving them, without giving any reason.
To exercise this right, contact us at info@ballielive.nl before the 14-day period ends. After notifying us, you must return the goods within 14 days, in their original condition where possible.
We will refund the amount you paid, including standard delivery costs, within 14 days of receiving the returned goods or proof that they have been sent back. Certain items that are excluded from the right of withdrawal under applicable law (for example, personalised or custom-made products) may not be eligible for return.
You will bear the direct cost of returning the goods. You may use the model withdrawal form, but this is not mandatory — any clear statement of your decision to withdraw is sufficient.
8. Intellectual property
All content displayed on our website and within the Ballie Live app — including but not limited to text, images, icons, illustrations, designs, graphic elements, visualisations, rankings, statistics, and other content — is the exclusive property of Ballie Live, unless otherwise stated.
The images and logos used within the app to represent clubs, teams, competitions, cups, and tournaments have been developed by Ballie Live and constitute original intellectual property of Ballie Live. These designs are protected by copyright and may not be copied, reproduced, distributed, modified, published, or used commercially without the prior written permission of Ballie Live.
The use of a club, team, competition, or tournament name does not imply any official cooperation, sponsorship, endorsement, or affiliation with the organisation concerned, unless explicitly stated by Ballie Live.
9. Liability
Ballie Live shall not be held liable for:
• any direct or indirect damages
• damages resulting from the use of the website or app
• damages resulting from inaccurate or incomplete information
Use of the website and app is entirely at your own risk. Nothing in these terms limits any rights you have as a consumer under applicable law.

10. Subscription Services and EULA
10.1 Subscription Access
Ballie Live offers subscription-based services that provide access to premium content, features, and benefits available through the platform.
By purchasing a subscription, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the subscribed services for your personal, non-commercial use, subject to these Terms and Conditions.
The subscription does not transfer ownership of any content, software, intellectual property, or platform functionality to you.
10.2 Subscription Plans
Subscription plans, pricing, billing periods, and included features are displayed at the time of purchase.
We reserve the right to modify subscription plans, features, or pricing. Any changes will not affect an active subscription period already paid for and will apply only to future renewals where permitted by applicable law.
10.3 Automatic Renewal
Unless otherwise stated during checkout, subscriptions renew automatically at the end of each billing period.
By purchasing a subscription, you authorize Ballie Live and its payment providers to charge the applicable subscription fee using your selected payment method for each renewal period until the subscription is cancelled.
You may cancel automatic renewal at any time through your account settings or by contacting our support team.
10.4 Cancellation
You may cancel your subscription at any time.
When a subscription is cancelled:
Your subscription will remain active until the end of the current paid billing period.
No further renewal charges will be applied.
Access to subscription features will end when the current subscription period expires.
10.5 Refund Policy
Unless required by applicable law, subscription payments are non-refundable once the subscription period has begun.
No full or partial refunds will be provided for:
Unused subscription periods;
Partial months or billing periods;
Failure to use the service;
Account suspension resulting from a violation of these Terms.
Nothing in this section limits any statutory consumer rights that cannot legally be excluded.
10.6 Free Trials and Promotional Offers
From time to time, Ballie Live may offer free trials or promotional subscriptions.
Unless otherwise stated, a subscription may automatically convert to a paid subscription at the end of the trial period. Users are responsible for cancelling before the trial expires if they do not wish to continue with a paid subscription.
10.7 License Restrictions
You agree not to:
Share, resell, sublicense, or transfer subscription access to any third party;
Circumvent or attempt to circumvent subscription restrictions;
Copy, reproduce, distribute, or commercially exploit content made available through the subscription service;
Use automated systems, bots, or scripts to access subscription content without authorization.
Violation of these restrictions may result in suspension or termination of your subscription without refund.
10.8 Suspension and Termination
Ballie Live reserves the right to suspend or terminate subscription access if:
Payment cannot be processed;
Fraudulent activity is suspected;
You violate these Terms and Conditions;
Continued access would create security, legal, or operational risks.
Where reasonably possible, we will provide notice before termination.
10.9 Changes to the Subscription Service
We continuously improve our services and may add, modify, replace, or remove features from subscription plans.
While we aim to maintain service availability, we do not guarantee that any specific feature, content item, or functionality will remain available indefinitely.

12. Governing law
These terms and conditions are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands. This does not affect any mandatory consumer protection rights you have in your country of residence.
